If you kill a person inside your home while they are attempting to rob you, can you be imprisoned?

Article 245 of the Penal Code states that the use of deadly force in legitimate self-defense of oneself, property, or honor may exempt a person from punishment, but under specific conditions:

1. Existence of a real danger
   There must be an actual threat to your life, property, or honor that justifies self-defense.
2. No other available means
   There must be no other way to prevent the danger except by using force.
3. Proportionality of force
   The force used must be proportionate to the attack, without exaggeration or excessive response.

When can you be imprisoned?

If it is proven that you used excessive or unjustified violence.

If the situation did not pose a real threat to your life that required killing the attacker, and he could have been stopped without killing him.

If the killing occurred after the danger had already ended.

For example, if the theft had ended and you killed the thief while he was fleeing, this may be considered outside the scope of lawful self-defense.

In all cases, the Public Prosecution investigates the incident to determine whether it was legitimate self-defense or an unlawful excess of that right, as each case varies depending on its specific circumstances and details.
