In the Sanctuary of Justice
Law is not merely a collection of rigid texts recited in courtrooms, nor is it simply a profession for earning a living. Rather, it is a noble humanitarian mission and an authentic partnership with the judiciary in uncovering the truth and establishing the balance of justice. Throughout many years of practice before Criminal Courts and the Court of Cassation, certain convictions become firmly rooted in a lawyer's conscience: that a right does not disappear as long as there is someone who seeks it with awareness and determination, and that divine justice remains the ultimate framework governing the outcomes of life and the destinies of people.
In these lines, I share with you a summary of professional and human experiences and messages that may illuminate the path for young lawyers and restore hope to anyone seeking justice after suffering a grievance.
First: Golden Advice for Young Lawyers
To every young colleague taking the first steps along this challenging yet honorable path, I place before you essential principles for building a successful and trustworthy lawyer:
Careful Reading... The Key to Acquittal
A case should never be read only once. Read the papers once, twice, and three times. With every reading, you may discover a precise detail or a procedural flaw that had previously gone unnoticed. That seemingly minor detail may be the direct reason for changing the course of a case from conviction to acquittal.
The Client Is a Partner Built on Trust
Treat your client as a friend looking for a safe haven. When a client feels secure and trusts his lawyer, he will reveal the most sensitive details and factual background that may not have been recorded in the official investigation documents. Such details often make a fundamental difference before the court.
The Nobility of the Mission and the Human Dimension (The Secret of the Black Robe)
Law is a profession of assistance and service. Never allow legal fees to become an obstacle to defending an oppressed person. It is a source of pride that the lawyer's robe was historically designed in Egypt and France without pockets, serving as a symbolic reminder that a lawyer wears the robe in support of truth and humanitarian duty before any material consideration.
Professional Appearance and the Lawyer's Prestige
The Legal Profession Law requires its members to maintain an appropriate appearance. A lawyer represents both the profession and the client. Professional attire, dignity, and composure in court are an integral part of the strength of legal defense and respect for the sanctuary of justice.
Second: A Lesson from Fate... Divine Justice Does Not Overlook
“Crime Does Not Pay... and God's Judgment Is Ultimately Inevitable”
One of the most unusual cases I handled during my career involved a simple citizen who had been accused 25 years earlier of an incident of assault resulting in death, involving his mother following an unfortunate dispute. At the time, his siblings waived their rights, and the court exercised the utmost degree of leniency, sentencing him to only three years in prison, after which he was released.
A full quarter of a century passed, and the same person was later accused in a case involving the possession of an automatic weapon without a license. From a procedural standpoint, the case presented strong grounds for acquittal due to the absence of material control over the weapon and the invalidity of the authorization. However, divine will and fate had another course; the court decided to include his previous criminal record and sentenced him to life imprisonment with hard labor.
When I met him after the judgment, deeply affected by what had happened, he surprised me with words that remained engraved in my memory as a profound reflection on divine justice. He said:
"Mr. Mohamed, the three years I previously spent in prison were the punishment for the weapon for which I had not been punished, and the life sentence today is the fair retribution for my mother's blood, which I thought I had escaped in this world... I accept God's judgment with justice and truth."
It is a profound lesson for every human being: procedural defenses may sometimes escape human scrutiny, but the balance of divine justice never overlooks a right or allows it to be lost.
Third: The Battle of Defense... How Hope Is Created from the Heart of Despair
“The Golden Rule: In Judgments, Reality Matters More Than the Description Given in the Papers”
One of the most difficult legal battles I faced involved a criminal case in which my client was accused and sentenced to life imprisonment. We challenged the judgment before the Court of Cassation, and the judgment was indeed overturned for a retrial. During the retrial proceedings, a serious procedural error occurred: the court secretary recorded in the minutes that a lawyer was present as an attorney for the absent defendant, despite the absence of any power of attorney authorizing him to do so.
As a result of this error, a judgment was issued in the defendant's presence sentencing him to 15 years in prison. The second appeal before the Court of Cassation was rejected, making the judgment final and legally enforceable, seemingly closing all traditional avenues.
But a true lawyer does not know despair:
-
We undertook a difficult legal battle that lasted for more than three years.
-
An official investigation was opened by the Public Prosecution to establish the inaccuracy of the entry recorded in the court minutes, relying on the established legal principle that “the truth of reality prevails over the apparent description of the judgment.”
-
We submitted a detailed grievance supported by compelling legal arguments before the First Attorney General of the Appellate Prosecution, who issued a courageous legal decision allowing the defendant to request the reopening of the proceedings on the basis that the judgment was, in reality, issued in absentia.
-
The retrial took place before a new Criminal Court circuit, which, after examining the facts, issued a complete acquittal, allowing the defendant to return to his family and freedom with his head held high.
Conclusion: A Commitment and a Mission
Being a lawyer is a heavy responsibility and a great trust before God and society. Our success as lawyers is not measured solely by the judgments we win, but by the extent of our dedication to making every possible effort, adhering to the principles of legal knowledge and law, and protecting people's rights, honor, and property.
We will always remain in the service of justice, supporting the judiciary and standing beside everyone who turns to us seeking truth, justice, and fairness.
