The situation of pregnant inmates raises important legal and humanitarian questions, particularly regarding how they are treated during pregnancy and after childbirth inside prisons. The law clearly regulates these matters to protect both mother and child.

According to prison regulations, pregnant inmates are entitled to special medical care from the moment pregnancy is confirmed through an official medical report. This includes proper nutrition, suitable living conditions, and adjustments in workload to match their health needs.

The law also mandates comprehensive care for both the mother and her child after birth, including appropriate food, clothing, and rest, while strictly prohibiting the deprivation of essential needs.

Regarding the child, the law allows the infant to remain with the mother in prison until the age of four, with the mother required to care for the child during the first two years.

If the mother chooses not to keep the child, or once the child reaches the specified age, custody is transferred to the legally entitled guardian. If no guardian is available, the child is placed in a care institution, while ensuring the mother’s right to be informed of the child’s location and to visit regularly.

This legal framework aims to balance the enforcement of punishment with humanitarian considerations, especially in safeguarding the rights and well-being of both mother and child.
