Amid the ongoing debate surrounding the new amendments to Egypt’s Family Law, attorney Magdy Lotfy Slaka, a specialist in personal status and family law cases with more than 40 years of legal experience, shared his legal perspective on several controversial articles within the current law. He emphasized that the law, in its current form, requires a complete restructuring to ensure fairness for both men and women.

During the press interview, Slaka explained that the primary goal of any legislative reform should be preserving the stability of the Egyptian family, rather than increasing disputes or complicating litigation procedures within family courts.


🟣 Family Dispute Resolution Committees Delay Litigation Instead of Facilitating It

Attorney Magdy Lotfy Slaka stated that one of the first aspects requiring reconsideration in the new Family Law is the “Family Dispute Resolution Committees,” explaining that these committees no longer fulfill the purpose for which they were originally established.

He noted that these committees were initially created to settle family disputes before reaching court; however, in practice, they now contribute to delaying litigation procedures and postponing parties from obtaining their legal rights.

Slaka added that, from his legal perspective, these committees should be abolished entirely, while benefiting from their employees by redistributing them across courts and prosecution offices to enhance the judicial system instead of increasing bureaucratic procedures that burden Egyptian families.

He further stressed that citizens involved in family disputes require quick judicial decisions, especially since most cases relate to alimony, child custody, and the psychological stability of children.


📌 Marriage Contracts & Gold Obligations Require Clear Legal Regulation

Magdy Lotfy Slaka also discussed the issue of the “Marriage List Agreement” (Qaima) within Egyptian society, emphasizing that the new law must establish clear regulations to prevent exaggeration or injustice toward either party.

He stated that the marriage list should have a clearly defined and limited value, along with more precise legal regulation regarding gold obligations.

According to Slaka, one of the major problems arises when some husbands are required to repay the value of gold based on current market prices during disputes, despite the fact that gold prices at the time of marriage were significantly lower.

He explained that in some cases, husbands are forced to pay excessively large amounts due to rising gold prices, even though the original value of the jewelry at marriage was much lower. He stressed that the new law must provide balanced and fair solutions to this issue.

He clarified that the objective is not to deprive women of their rights, but rather to establish a fair legal framework that protects both parties without imposing unreasonable burdens on either side.

Regarding child custody age, Magdy Lotfy Slaka explained that the current custody age limit requires reconsideration, noting that children around the age of 15 enter a critical developmental stage where the father’s role becomes increasingly important.

He pointed out that children during adolescence require guidance, supervision, and parental support, making the father’s role essential in education and important life decisions.

Slaka added that his legal vision includes reducing the custody age compared to the current system while placing fathers among the primary custody priorities, emphasizing that the father’s presence in a child’s life is a psychological, social, and educational necessity.

Slaka also addressed the issue of “obedience notices,” explaining that repeated obedience lawsuits and counterclaims between spouses often create financial and psychological exhaustion for both parties.

He explained that some husbands repeatedly send obedience notices, while wives are forced to respond through multiple objections and lawsuits, resulting in significant procedural and financial pressure on the family.

He emphasized that the new law should regulate this matter more clearly by allowing courts to issue one decisive ruling regarding obedience requests instead of repeating procedures that increase family disputes.


💰 Family Court Fees Have Become an Additional Burden

Slaka also discussed court fees within Egyptian family courts, confirming that some legal fees have become a major burden on women and low-income families.

He explained that the original purpose behind establishing family courts was to simplify citizens’ access to justice; however, increasing procedural fees now negatively affects many families’ ability to continue litigation.

He noted that some women can no longer easily obtain copies of court rulings or continue legal procedures due to rising costs, calling for greater consideration of families’ economic conditions within the judicial system.
