The Cairo Criminal Appeals Court, presided over by Counselor Medhat H elmy Kassab, with Counselors Amr Abdel Qader Sabry, Sameh Said Ahmed and Tamer Abdel Salam El-Nefrawy, and court clerks Magdy Shokry and Tamer Hammad, accepted the appeal and upheld the first-instance verdict in the case involving the killing of Nasser Beshay Soliman Shenouda and the seizure of his car, mobile phone and money.
The ruling maintains a death sentence by hanging for the first defendant, 10 years of rigorous imprisonment for the second defendant, and two years in prison for the third defendant.
Details of the Nasser Beshay Shenouda Murder Case
The incident dates back to July 26, 2024, in the Mokattam Police Department jurisdiction.
According to the referral order and the court's reasoning, the defendants agreed to kill the victim after an alleged dispute involving the second defendant, who was the first defendant's wife and the third defendant's mother, in addition to their financial difficulties.
How the Victim Was Lured
According to the court's reasoning, the defendants planned to lure the victim to their residence by taking advantage of his work as a cargo transport driver.
Investigations stated that the first defendant contacted the victim and told him that he wanted to transport some belongings from his home. The victim agreed and went to the location without knowing about the alleged plan.
Attack Inside the Residence
The first defendant prepared a knife. Once the victim arrived at the residence and entered with the first defendant, he allegedly stabbed him several times in different parts of his body.
The court also stated that the second defendant participated in the assault, while the third defendant played a role in carrying out the plan, including bringing the rope used to restrain the body.
Restraining the Body and Taking the Victim's Car
After confirming the victim's death, the defendants allegedly restrained the body and wrapped it in fabric and plastic coverings before placing it inside his car.
They then drove the vehicle to a remote area, where they disposed of the body, before taking the victim's car, mobile phone and money.
Hiding the Car and Selling the Phone
The defendants drove the vehicle to Beni Suef Governorate before returning to Cairo and hiding the car inside a garage in the Moneeb area of Giza.
Investigations found that the first defendant sold the victim's mobile phone to another person for EGP 400. Authorities later recovered the phone from the buyer.
The victim's car was also recovered, and blood traces were reportedly found in its rear cargo area.
Evidence Presented in the Case
The court based its conviction on several pieces of evidence, including witness statements, police investigations and the defendants' statements during Public Prosecution investigations.
The evidence also included a reenactment of the crime, the forensic autopsy report and surveillance camera recordings.
Findings of the Forensic Report
The forensic report established that the victim had several stab wounds to the neck, back and abdomen.
The injuries caused damage to major blood vessels in the neck as well as injuries to the lungs and intestines. The report concluded that these injuries caused his death.
Investigations also established that the victim's wife had reported him missing before identifying his body after it was found in a remote area.
First-Instance Court Sentences
The first-instance court had referred the first defendant's case file to the Grand Mufti to obtain a religious opinion regarding the death penalty.
The court subsequently sentenced the first defendant, Yasser R. S. to death by hanging, sentenced the second defendant, Roqaya E. A., to 10 years of rigorous imprisonment, and sentenced the third defendant, Kyrillos A. B., to two years in prison.
Cairo Appeals Court Ruling
After reviewing the appeal, the Cairo Criminal Appeals Court accepted it and upheld the first-instance judgment.
The sentences therefore remain unchanged: death by hanging for the first defendant, 10 years of rigorous imprisonment for the second defendant, and two years in prison for the third defendant.
