Ali Gomaa: Islam Prohibits Pressuring Women to Waive Their Financial Rights

Dr. Ali Gomaa emphasized that Islam strictly forbids forcing a woman to give up her financial rights, such as dowry or inheritance, highlighting that such actions are considered oppression and contrary to Islamic teachings.

Dr. Ali Gomaa, former Grand Mufti of Egypt and member of Al-Azhar’s Council of Senior Scholars, explained that Islamic law was revealed to protect and preserve women’s rights, and it does not permit any form of coercion or pressure to make a woman relinquish her established financial entitlements, whether dowry, inheritance, or otherwise.

He cited the Quranic verse: {And if you replace one wife with another and you have given one of them a great amount [in gifts], do not take [back] from it anything}, affirming that the verse clearly prohibits any injustice toward women in cases of divorce or separation.

He further stated that unlawfully taking a woman’s rights is described in the Quran as a clear sin and falsehood, not subject to manipulation or misinterpretation. Islamic ethics encourage kindness, emotional consideration, and respect within marital relationships.

He added that a righteous man does not view marriage merely as a permissible relationship, but as a commitment that involves compassion, good character, and mutual respect. He also referenced examples from scholars who prioritized protecting their wives’ feelings and avoiding emotional harm.

Dr. Gomaa stressed that while Islamic law establishes rights firmly, noble ethics call for preserving feelings and avoiding psychological harm. A woman is entitled to her full dowry regardless of its size, and it is not permissible for a husband to reclaim any part of it upon separation.

He also noted that anyone entering marriage must be financially and morally capable of fulfilling its responsibilities, as failure to do so may lead to injustice, which is strictly forbidden.

He concluded by emphasizing that marriage is a solemn covenant based on trust and intimacy, and because of its depth, fairness and loyalty are essential, while injustice within it is considered particularly grave.
