Can a Husband Return After Irrevocable Divorce? Egyptian Fatwa Explains in Detail

Egypt’s Dar Al-Ifta clarifies the rulings on irrevocable divorce and when reconciliation is allowed.

In a detailed clarification of Islamic family rulings, Hend Hammam, Fatwa Advisor at Egypt’s Dar Al-Ifta, explained the rules regarding reconciliation after irrevocable divorce.

Minor irrevocable divorce (Ba’in Sughra)
She stated that this occurs after the first or second divorce once the waiting period ends, and reconciliation is only possible through a new marriage contract and dowry with the woman’s consent.

Major irrevocable divorce (Ba’in Kubra)
In the case of the third divorce, reconciliation is not permitted unless the woman enters a valid marriage with another man, which must be genuine and not pre-arranged, and ends naturally before returning to her first husband.

Purpose of the ruling
She emphasized that these rules aim to prevent manipulation through so-called “halala marriage,” stressing that the second marriage must be sincere and not a formality.

Reconciliation during waiting period
If the divorce is first or second and the waiting period has not ended, the husband may return to his wife without a new contract.
