Does Divorce Occur When Swearing Not to Visit One’s Mother? Fatwa Authority Clarifies
An Egyptian Fatwa official clarified the ruling on swearing divorce not to visit one’s mother, stating that it does not count as divorce but requires expiation and repentance.
Sheikh Owaida Osman, a senior Fatwa official at Egypt’s Dar Al-Ifta, answered a question regarding the ruling of a man who swore an oath of divorce not to visit his mother.
Repentance First
He explained that such behavior is not merely an oath issue but requires sincere repentance to Allah, as it may fall under the category of disobedience to parents.
Disobedience to Parents
He emphasized that causing sadness to parents is a form of wrongdoing, stressing that true righteousness lies in honoring parents and seeking their happiness.
Misunderstanding Between Generations
He noted that what children may perceive as interference from parents is often driven by love and concern for their well-being.
Does Divorce Occur?
He confirmed that this type of oath does not usually intend divorce, therefore no divorce occurs; it is treated as an oath requiring expiation.
Expiation for the Oath
The expiation includes feeding or clothing ten poor people, or fasting three days if unable, along with repairing the relationship with one’s mother and showing kindness and respect.
