Can an Employer Delay an Employee's Salary?

Dr. Ali Fakhr, Secretary of Fatwa at Egypt's Dar Al-Ifta, stated that Islamic law does not permit delaying an employee's salary as long as the employee has fulfilled their duties properly. He emphasized that wages are a guaranteed right that should not be withheld without a legitimate reason.

The Employer-Employee Relationship in Islam

Mutual Rights and Responsibilities

According to Dar Al-Ifta, the relationship between employers and employees is based on mutual obligations. Employees are required to perform their work honestly and professionally, while employers are obligated to pay wages on time, ensuring justice and preventing unfair treatment.

When Can Salary Payment Be Delayed?

Cases of Negligence or Damage

Dr. Fakhr explained that exceptional situations may arise if an employee causes damage through negligence or misconduct.

However, employers are not allowed to withhold wages based solely on personal judgment. A proper investigation must first determine whether the employee was actually responsible.

Investigation Determines Salary Entitlement

If the investigation confirms that the employee performed their duties according to professional standards, they are entitled to receive their full salary without delay.

If negligence is proven, the extent of the damage should be assessed before any legal or financial action is taken.

Resolving Employment Disputes

Dar Al-Ifta stressed that disputes between employers and employees should be referred to the competent authorities, which can fairly examine the case and ensure that the rights of all parties are protected in accordance with both legal and Islamic principles.

Is it permissible to delay an employee's salary without reason?
No. Dar Al-Ifta states that delaying wages without a legitimate reason is prohibited.

When can salary payment be delayed?
Only in exceptional cases where negligence is suspected and after an official investigation.

Can an employer withhold wages unilaterally?
No. A proper investigation must determine responsibility before any decision is made.

How should disputes between employers and employees be resolved?
By referring the matter to the competent legal authorities.

What is the basic principle of employment in Islam?
Employees perform their duties faithfully, and employers pay wages promptly while respecting each other's rights.
