Rights Between Spouses in Islam

She explained that Islamic law establishes mutual rights between spouses, requiring the wife to fulfill her marital duties and the husband to provide maintenance and treat her kindly.

Definition and Conditions of Nushuz

She clarified that “nushuz” is only established under two conditions:

• The wife unjustifiably refuses to fulfill her marital obligations.
• Absence of a valid religious, medical, or psychological excuse.

If a legitimate excuse exists, the wife cannot be considered nashiz.

Judicial Authority Only

She emphasized that declaring a wife as nashiz is not the husband’s or family’s authority, but strictly the court’s responsibility after examining both parties.

Legal Consequences

She noted that one of the legal consequences—if proven by a court ruling—is the suspension of the wife’s financial maintenance, which cannot be decided unilaterally.

Warning Against Individual Decisions

She warned that a husband withholding financial support based on personal judgment is religiously sinful, urging disputes to be resolved through courts or reconciliation committees.
